An Apple representative offered their thoughts on the matter. “Masimo has erroneously tried to utilize the ITC to prevent millions of American consumers from accessing a potentially life-saving product while paving the way for their own watch that imitates Apple’s design. Although the decision made today won’t immediately affect Apple Watch sales, we still think it should be overturned and will keep up our appeal.

It depends on the president

Although the ITC has issued a decision in Masimo’s favor, it won’t be implemented immediately. Users can still place their order for the Apple Watch 9. Right now, the decision is dependent on Biden’s administration since the president can veto the ruling, although there is less chance of this. He has sixty days to decide.
