Huawei Sues the U.S. For Defense Bill As Trade War Heats Up

According to the latest reports, Huawei has filed a lawsuit against the U.S. government, it sues the U.S. for Defense bill and for illegally putting sanctions on Huawei. The Chinese global manufacturer has filed the case in U.S. District Court for the Eastern District of Texas on Tuesday.

The Chinese company asks for calling 2019 National Defense Authorization Act (NDAA) unconstitutional in an update to a lawsuit brought by Huawei in March, Reuters reported.

The Chinese tech giant argues that the portion of the law which restricts federal agencies from buying technology and equipment from Huawei Technologies Co. Ltd, as well as ZTE, is against the U.S. Constitution which forbids an individual or a group from trading and punishes without any trial.

Quoting Song Liuping Huawei’s Chief Legal Officer who said, “The US government has provided no evidence to show that Huawei is a security threat. There is no gun, no smoke only speculation”.

According to Paul Triolo a specialist at Eurasia Group in global technology policy, “The Huawei lawsuit would be a pyrrhic victory at best in the face of the new U.S. restrictions”. He also said,  the case seems the last gasp of the firm’s litigious approach to US actions, and if it is to survive … the company will have to sue for lenient treatment from the Commerce Department,”

According to CNBC Huawei wishes to rip apart the section 889 of NDAA which Huawei argues that is unlawful and Congress is acting like judiciary which is not lawful either. Huawei’s spokesperson said the U.S. court will hold hearings on opposing sides motions in September.
