Nintendo Files Complaint Against Accessories Manufacturers for Switch 2 Leaks

Nintendo is suing an accessory manufacturer because of the publication of 3D printed models of the Switch 2 before the official announcement. Allegations range from trademark violation, unfair competition and misleading advertising.

Nintendo has taken legal action against the Genki accessory company. The reason is the presentation of 3D printed models of the Nintendo Switch 2, which has not yet been officially announced, as part of the CES 2025 in January.

Genki CEO Edward Tsai caused a sensation when he not only showed the 3D models, but also claimed to have access to a real switch 2. Based on this statement, the company then presented its models and renderings and confirmed alleged functionalities of the unpublished console in interviews. Brand law problems

According to Nintendeal (via Bluesky) submitted Nintendo on May 2, 2025 to the US district court for the Central District of California. The company calls for the destruction of all Genki products that are connected to the Nintendo Switch or Switch 2. In addition, Nintendo requires the use of the use of its trademarks and compensation from the company. The argument had its origin in December 2024 when Genki publicly tweeted “Switch 2 accessories”. The highlight of this leak then only took place on the CES 2025, where Genki 3D models and a video presented with a rendering of the Switch 2, including the official brand logos. The provocations then continued: Genki posted a picture of his CEO with the caption “Genki-Ninjas infiltrate Nintendo’s headquarters in Kyoto” and announced his own “Direct” presentation, a clear indication of Nintendo’s format.

Uncertain future for Genki

Nintendo also confronted Genki with a crucial question: either the company actually has a legally procured switch 2, or it is deceptive to the public with false compatibility promises. Switch 2 is scheduled to be released on June 5, 2025, Genki now has 30 days to react to the allegations. This could lead to a cost -intensive legal dispute, since Nintendo is known to rigorously enforce its trademark rights.
